Working overseas could be tasking both for the employer and the prospective employee. The Australian government then created a convenient way to employ foreigners via the Temporary Skill Shortage TSS Visa.
What is a Temporary Skill Shortage Visa?
The temporary skills shortage visa subclass 482 has replaced Temporary Work Visa subclass 457 on March 19, 2019. This visa empowers Australian employers to employ foreign workers if there is a labour shortage. Labour shortage happens when Australian employers cannot find an Australian citizen who can do the job.
The TSS visa permits Australian employers to sponsor an employee from another country so the latter can work with them.
Qualifications for The Temporary Skill Shortage Visa
For the applicant to be eligible to apply for the TSS visa, their employment and educational background should match the standards mandated by the Department of Home Affairs. Their requirements follow the Australian New Zealand Standard Classification of Occupation (ANZSCO). Also, the position that the employer needs should appear in the Combined List of Eligible Skilled Occupations. Otherwise, you cannot avail of the temporary skills shortage visa.
Other requirements necessary for a Temporary Skills Shortage TSS Visa pertain to at least two years of relevant work experience. For your skills, it depends on the position you are applying for, but your capabilities and work experience will be cross-referenced by the DHA to ensure that you qualify for the job.
The employer who needs your skills must also nominate you for the position. Concerning this, you must make sure that your employer is a lawfully operating business, has to satisfy the salary and employment requirements, and should provide proof of Labour Market Testing if necessary. Labour Market Testing pertains to the business advertising for the nominated worker.
As for the English language requirements, you must meet the standards if you are from a country that is not exempt. Exempt countries in meeting this requirement are the United States, United Kingdom, New Zealand, Ireland, and Canada.
Health and character are also important factors. After you turned 16, you need to obtain a health certificate and police clearance from the country where you have stayed for a year or more.
How Long Does the Temporary Skill Shortage Visa Last?
The TSS visa is divided into three categories: the Short-Term stream, Medium-Term stream, and the Labour Agreement Stream.
The stream you will belong to will be determined by the position you apply for from the Consolidated Skilled Occupations List. If your job falls under the Short-Term stream, the maximum number of years you can stay in Australia via the Temporary Skills Shortage TSS Visa is two years. It is renewable only once for another two years.
If your occupation is under the Medium-Term stream, you can stay in Australia for four years. It is renewable for another four years. However, you should know that you are eligible for permanent residency in the country after three years with this stream.
For the Labour Agreement stream, employers are allowed to employ overseas skilled workers as long as they have a labour agreement with the DHA. It can also include a permanent residency option for the foreign worker.
